EB-1 (A)

The EB-1(A) visa, or Extraordinary Ability visa, is designed for individuals who have demonstrated exceptional talent in their field, achieving national or international recognition. Applicants must meet at least three of ten specified criteria, such as receiving lesser nationally or internationally recognized awards, membership in associations requiring outstanding achievement, or authorship of scholarly articles. Alternatively, evidence of a one-time achievement, like a major internationally recognized award, can also qualify. This visa category is suitable for those in fields like science, arts, education, business, or athletics.

To apply, individuals must file Form I-140 with U.S. Citizenship and Immigration Services (USCIS) along with supporting documentation. Unlike other employment-based visas, the EB-1(A) does not require a job offer or labor certification. Once the petition is approved, applicants can either adjust their status if they are already in the U.S. on a non-immigrant visa or go through consular processing to obtain an immigrant visa. This visa offers a quicker path to permanent residency for the applicant and their immediate family, making it an attractive option for highly accomplished professionals.
